GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale (the "GTCS") are binding on Wenxuan TANG, individual entrepreneur, under number 82423168200041, located at 58 rue de Monceau, CS 48756, 75380 Paris Cedex 08, France, (the "Artist").

Article 1 - Subject and Scope

1.1 The Artist’s activity is the creation of unique original artworks ("Creations"). They may be sold or commissioned remotely (by email or via the website), or directly during the Artist's participation in fairs or any other commercial event (the "Event").

1.2 Any Transaction implies the Client's full and unreserved acceptance of the GTCS, which prevail over any other document.

Article 2 - Creation as Subject of a Transaction

Creations are either existing or to be designed as part of a personalized request (the "Commission"). The Client becomes the owner of the physical support, but the Artist retains the copyrights.

Article 5 - Handover of Creations

Physical possession is transferred only after full payment of the price and delivery fees. Risks (loss, theft, damage) pass to the Client upon handover to the carrier or in person. The Client must inspect the package and issue formal reservations within 48 hours by registered letter.

Article 6 - Right of Withdrawal

Remote Sales: The Client has 14 days to withdraw (existing creations only). Return costs are the Client's responsibility.
Exclusions: The right of withdrawal does not apply to sales made during an Event (fair, exhibition), nor to custom Commissions once the creation has begun.

Article 3 - Price of Creations

The price is firm and final. It is quoted excluding delivery and insurance costs, which are payable additionally. The Client is responsible for any customs duties or local taxes for international sales.

Article 4 - Invoicing and Payment

Except for a Commission, payment must be made in full, upfront, and no later than thirty (30) business days from the invoice date. The Artist retains full ownership of the Creations until full payment is received.

Article 7 - Intellectual Property

The Artist holds the copyright. No Transaction involves the transfer of copyright. The Client's rights are limited to the physical ownership for private use.

Article 8 - Applicable Law and Jurisdiction

The GTCS are governed by French law. Any dispute shall be subject to the exclusive jurisdiction of the Paris courts.
